Once a defendant has been properly served with a no contact order or tremor restraining order they are not allowed to contact the plaintiff in any way shape or form and that would include a SMS or text message on a cell phone. If you have a court ordered TRO (Temporary Restraining Order) and you have been contact via SMS or text message that is a clear cut violation of the order. You can recover that deleted SMS and submit it as evidence in court as a violation of the order

The problem is that many times in the heat of the moment that text message will get deleted and you think that the evidence has been lost forever. But that is simply untrue. Those deleted text messages can be recovered through the process of cell phone forensics, This is when a cell phone or other digital communication device is submitted to an expert in forensic data recovery. The device is examined, the deleted pics, texts, SMS, call logs are all recovered and reduced to a report that can be submitted as evidence in your court case, This evidence will be solid proof needed to show that the other party has violated the court order restraining them from any contact with you.

Likewise this same forensic process can be used by a defendant to prove that they are being falsely accused of sending texts or SMS messages to the plaintiff in a TRO case. The accused can submit their device for examination and prove that so such texts were ever sent from their phone.

The whole process is quite affordable to any litigant and is also handled in a very timely fashion. Well within the time frame a person applies to the court for a TPO and the first court appearance for both parties to plead their case. So there is no excuse for either the plaintiff or defendant to have taken these steps to fortify their case and accusation or defense. Today the courts are well aware these types of forensic examinations are available to litigants and will look askance at litigants that come to court empty handed without any kind of forensic evidence.
