If you have a business dispute with someone, or a company has not completed a job that you paid them for, or you have had an accident that is not your fault, then you may want to challenge the people in a civil court. Civil courts do not work in quite the same way as criminal or family courts and you will need the help of a civil litigation solicitor who can advise you and find a barrister to take the case.
In a criminal case it is up to the lawyers who are prosecuting and defending a case to find the evidence that supports the story that their client is telling. In a civil case however, the claimant or person who is bringing the case, and defendant, person against whom the claim is made, must each produce their own evidence. Your civil litigation solicitor will tell you that if you are bringing a claim for compensation then you will need sufficient evidence or facts to take before the court if you want to prove your case. Your civil litigation solicitor will also tell you that the person against whom you are bringing the claim will have to present their own facts or evidence in their defence.
When you meet with your civil litigation solicitor they will take a statement of the facts from you which they will then present to the court in support of your claim against the other party. The person or company against who you are claiming should also get a solicitor presenting their statement saying which aspects of the claim they either admit to or deny. Your civil litigation solicitor will tell you that when your case actually goes to court, it is up to the court to question your evidence and any denials that the defendant may make. It is the task of the court to weigh up the facts that have been presented to them to see whether the claim stands or fails and whether the defendant's denial or responsibility stands.
Your civil litigation solicitor will advise you that the court may give directions if there are certain issues where extra or key facts and evidence are wanted. If the court is not satisfied with the evidence provided but does not yet think the case has failed, it may ask for further evidence or for that evidence to be presented to the court in a particular way.
