When couples cannot agree over issues concerned with children or property, they may be requested to go for mediation. If mediation is successful then an agreement is drawn up but this is a Mediation Agreement and not a legal document until your divorce solicitor has presented it to the court as a consent order and the court makes their decision. Once a court has agreed to the contents of a consent order, it is then a legal document.
Your divorce solicitor is there to advise you on a consent order. If you think that the other person has not told the truth when the agreement was drawn up or if a mistake was made when the agreement was put together, the court may allow the consent order to be overturned. It is not easy to overturn a consent order and your solicitor will explain the divorce laws and what needs to happen for an order to be overturned.
Normally you would only request that a consent order is overturned if something has happened since it was granted to make you doubt what the other person was saying, or think that the order was not drawn up properly. A good divorce lawyer will be able to tell you that it is not possible to get a consent order overturned if an event has taken place and more than twelve months have passed since the order was granted. Whatever your reason for wanting the order overturned it either has to have happened before the divorce was finalised or else was something that was not properly taken into consideration at the time.
Your divorce solicitor can help you if you want to get a consent order overturned but the problem has to be one that upsets all the other terms of the consent order if a court will consider overturning it. The divorce laws say that if you want to have a consent order overturned, your divorce lawyer has to make an application to the court as soon after as possible when the issue was discovered. If there are any children mentioned in the court order and overturning it would be to their detriment then a court may not rule in your favour.
When a consent order concerns property and assets your divorce solicitor will tell you that under such an order any personal possessions at issue will be the property of the person who had them at the time the consent order was drawn up.
