Fighting My Leak in Court

When I first discovered some leaking around the light in my bedroom, I was worried. I knew my cheap landlord would not want to pay the repair cost of the leak. I would have to chase him, call him around the clock, and generally create a stink to get the problem solved. I knew that if I wanted my landlord to take care of the problem I needed proof, so I called a leak detection service.

I thought that dealing with a water leak detection agency would be hard, but that was the easy part. Representatives showed up and they didn't even have to drill in my ceiling. They used an infrared sensor to tell me where the problem was. Although the water intrusion was occurring in my bedroom, the source of the water was, in fact, a roof leak over my kitchen. The representatives from the leak detection agency told me the leak was not severe, but that it could grow in size and scale if I did not act quickly. They said that they also suspected that it was a problem in the tar on the roof and that it would be wise to re-tar a small section of the roof.

I took this information to my landlord and he still did not want to pay for the damages. I threatened to take him to court and I showed him the information that I had obtained from the leak detection service. It proved that I was in no way culpable in the issue and that it was the landlord's responsibility. When he saw that he started singing a different tune. He not only agreed to pay for the leak, he also re-tarred the weak section of roof. And, he paid for some of my water damaged goods and reimbursed the leak detection costs.

I am happy that I decided to get a professional water intrusion inspection. It gave me the ammo I needed to make my landlord act. Too often, tenants do not understand their rights or are too scared to act out. Unless you really go out of your way to mess up your roof or plumbing, leaking is usually something your landlord has to pay for. It's not your fault that the building was built shabbily or that it hasn't been improved on since before the FDR was president. Once you have the indisputable proof in your hand, it will be hard for your landlord to ignore you.
