There are already some 1.7 million uninsured drivers on our roads, and it is thought the difficult economic climate will cause numbers to rise considerably over the coming years. Unfortunately, this reality adds an extra £40 to the average motor insurance premium, meaning it is responsible drivers who must bear the cost of uninsured drivers.
Can You Still Claim If The Other Driver Is Uninsured?
However, there is some good news. Many people wrongly believe that if you are involved in an accident with an uninsured driver, it will not be possible to make a personal injury claim. But this simply isn't true. In actual fact, if you suffer harm because of an uninsured driver, you are legally entitled to make a claim. If successful, you will be awarded compensation for the pain and suffering you have been caused.
Nevertheless, claims against uninsured drivers do differ from ordinary claims. Rather than taking a claim through the other party's insurance company, it must instead be made through the Motor Insurance Bureau (MIB).
Funded by all UK insurance companies, the MIB was set up in 1946 to help those injured by uninsured and untraced drivers. Although the process is slightly more complicated, it is still possible for these victims to obtain the compensation they rightfully deserve.
How To Make A Whiplash Claim Against an Uninsured Driver.
To make a whiplash claim against an uninsured driver, you need to take the following steps:-
* Take as much information as possible at the time of the accident. This includes the other driver's name, contact details and registration number;
* Report the accident to the police;
* Seek medical attention for your whiplash injuries;
* Contact a solicitor who is able to deal with claims against uninsured drivers.
Contact Whiplash Experts.
If you have suffered a whiplash injury which was caused by an insured driver, contact expert whiplash solicitors today and speak to a specialised solicitor. They will be able to assess you case and advise you upon your legal position. If the other party is indeed responsible for your whiplash-associated disorder, they can use their professional expertise to handle your case from start to finish.
The first step would be to run a search through the Motor Insurance Database. This is a record of all the insured vehicles in the UK, and will allow them to check whether or not the other party was covered by insurance at the time of the accident. If not, they will take your claim through the Motor Insurance Bureau, helping you to obtain the compensation you are legally entitled to.
