No win no fee agreements, or Conditional Fee Agreements (CFAs) as they are sometimes known, were first introduced in the UK in 1995. The system was implemented to ensure that all victims of personal injury had access to justice - irrespective of their financial situation or social standing.
The arrangement has been devised so that those making a claim will not have to pay any costs whatsoever, regardless of the outcome. This means that you need not worry whether or not your case is successful, as you will be protected financially in both situations. This can be explained as follows:-
* If you win your case - Your solicitor will only be paid if your case is successful. However, this will not be paid by you. * If you lose your case - If your case is not successful, your solicitor will not receive any legal fees. As the losing side, you may be concerned that you will then be responsible for paying the other party's costs. However, you will be protected against this by an insurance policy, which your solicitor will arrange on your behalf. This is called After the Event (ATE) insurance, and will cover any costs incurred.
