The Pros and Cons of UK Prenup Agreements

A UK Prenup [or pre-nuptial] agreement is becoming more prevalent in this country, even though they have yet to become recognised by the law.

The main advantage they have to offer is that they set down the wishes of both parties before they get married. The wishes concern the division of financial assets that both parties had before marriage. If no UK Prenup agreement is in place, it is very likely that the assets would be divided equally between both parties. This may not be to the liking of the partner who had more to contribute to the marriage in the first place.

There are pros and cons to such an agreement of course. For example UK Prenup agreements are not yet recognisable officially by the law. However this looks to be changing fairly soon, as they become more widespread and more parties call for this change to be made.

Another benefit of UK pre-nuptial agreements is that they give the couple a firm footing to start on in marriage together. Of course some believe that the romance is taken out of the marriage simply by discussing the idea of getting an agreement of this nature. But many other things of a practical nature need to be discussed when a couple is about to marry, so this should not be any different.

Another aspect of this situation concerns the potential inheritance issues which could arise. Nowadays some couples are marrying later in life and they may already have children whom they need to consider. Everyone wants to assume they will stay happily married for a long time but if this is not the case the parent of the child concerned will want to ensure they are taken care of. Any inheritance from their side of the relationship can be mentioned in a UK Prenup agreement, so that the needs of the child will not be jeopardised.

The issue of trust also comes up with this kind of agreement. Some people think you should enter into marriage in total trust and honesty. But of course even if this is the case initially, a lot can happen during the course of a lifetime. A pre-nup can ensure that if the worst should happen and you find the need to consult divorce solicitors, all the bases have been covered. In a sense a prenup can therefore provide peace of mind, when the situation may otherwise be tenuous. Once the agreement is set down [and you will both need independent advice on your prenup from separate specialist divorce solicitors], the couple can get on with their lives together and not think about it again. If you think about it, it is much like any other form of insurance - one that you hope never to need.
