In August 2010 DePuy - the orthopaedic arm of Johnson & Johnson - recalled the ASR XL Acetabular Hip System and DePuy ASR Hip Resurfacing System.
These systems had been seven years earlier after being thoroughly tested. Prior to the hip replacement recall these two systems had been hailed as a major development in hip replacement medical technology.
So where does the recall leave those who had one of those systems implanted. And will they be able to seek hip replacement compensation. The answer to the compensation is most probably yes, especially if they seek legal advice from specialist hip replacement compensation lawyers.
The fact is that many of those who had those DePuy systems implanted prior to hip replacement recall have suffered. In the work case scenarios some have seen the implants become loose, they have had bones surrounding the implant and cases of blood poisoning - Metallosis - blood poisoning caused by the metal in the implant. Some people have suffered nerve, tissue, muscle damage and swelling, extreme pain and difficulty walking. And in several cases the sufferers needed a second operation
Those who have so far suffered no problems since their hip replacement operations may well do so sometime in the future. So if they had ASR XL Acetabular Hip System or DePuy ASR Hip Resurfacing System fitted prior to the hip replacement recall they should also seek legal advice.
Both for anyone seeking legal advice, and ultimately beginning the process of seeking compensation, they should first check if they have been fitted with one of the DePuy systems. This can be found out by contacting the surgeon who performed the operation. If someone finds they have been fitted by one of the recalled systems then they should consider contacting a solicitor who deals with hip replacement compensation claims.
Often the first consultation with a specialist medical negligence solicitors is free and can be conducted over the phone. Some people will be suffering severe mobility issues, and depending where they live the practice may be able to offer home visits. It may also be possible for the whole matter to be dealt with without the client having to visit the practice, by using the telephone, email, or Skype.
While DePuy have offered to make some kind of payment to people who have suffered because of their hip replacement systems, claimants may be able to secure so much more. The lawyer may be able to win them extra compensation for medical negligence and pain and suffering. That is why it is so important people seek specialist legal advice.
