There are few, if any people, who enter into marriage with the idea that if things don't work out you can always get divorced. It is never easy when a marriage breaks down and the problems increase significantly if there are children of the marriage and if there is property or investments to take into account. In the eyes of the court, they are not interested in guilt in divorce, e.g. in case of adultery etc. the only grounds under which a divorce is granted is the irretrievable breakdown of your marriage.

Under current legislation regarding divorce laws your divorce lawyer may suggest that you and your partner go for mediation. The courts prefer couples to go for mediation as this is where financial arrangements can be agreed, and also which partner will have residence for any children and stay in the family home. If you have children then you will definitely be required to go for mediation as the courts prefer it if custody, access and residence are agreed between you and your spouse.
